Action Following a Valid Notice

After receiving a complete and valid copyright infringement notice, we may:

  1. Remove or disable access to the material alleged to be infringing;
  2. Notify the person or content provider responsible for the material that it has been removed or disabled; and
  3. Suspend or terminate access to our services where the person or content provider is found to be a repeat infringer.

We may request additional information before taking action if the notice is incomplete or does not provide enough detail for us to identify or assess the material.

Counter-Notice Procedure

A person whose content has been removed or disabled may submit a counter-notice if they believe that the material was removed because of a mistake or misidentification, or that they have permission or a lawful right to use the material.

The counter-notice must include:

  1. A physical or electronic signature of the person submitting the counter-notice.
  2. Identification of the material that was removed or disabled and the location where it appeared before removal.
  3. A statement that the person has a good-faith belief that the material was removed or disabled because of a mistake or misidentification.
  4. The person’s full name, postal address, telephone number and email address.
  5. A statement confirming that the person will accept service of legal proceedings from the party who submitted the original infringement notice or their authorised representative.

Counter-notices should be sent to:

Email: contact@stneotsgiftsandtoys.uk

After receiving a valid counter-notice, we may send a copy to the person who submitted the original complaint. Where permitted by applicable law, the removed material may be restored unless the original complainant informs us that legal proceedings have been started concerning the disputed material.

False or Misleading Claims

Submitting a false, misleading or fraudulent copyright complaint or counter-notice may result in legal liability. Anyone submitting a notice should ensure that the information provided is complete, accurate and made in good faith.

Repeat Infringers

We reserve the right to suspend or permanently terminate access to our website or services for users or content providers who repeatedly infringe the intellectual property rights of others.
